The CBN has proposed a 48-hour refund policy for Authorised Push Payment (APP) fraud victims, a controversial yet necessary step to restore public trust in digital transactions. But here's where it gets interesting: this proposal is part of a larger framework to tackle the growing incidence of fraud through social engineering and deception.

The draft guidelines, titled "Guidelines for Handling Authorised Push Payment Fraud," outline a comprehensive approach. Banks and financial institutions will be required to investigate reported APP fraud cases within 14 working days and provide refunds within 48 hours of concluding their investigations. This swift action is designed to mitigate financial losses and strengthen consumer confidence.

But the guidelines go further. They clarify the conditions under which victims are eligible for reimbursement, emphasizing the importance of timely reporting and the absence of negligence or criminal intent. Banks are also tasked with exercising a higher duty of care towards vulnerable customers, a critical aspect often overlooked in fraud cases.

However, the 72-hour reporting requirement is not set in stone. The draft acknowledges exceptional cases where this timeline may be waived, such as when customers face security constraints or lack access to reporting channels. This flexibility ensures that victims are not penalized for circumstances beyond their control.

The CBN is taking a hard line on institutions that fail to comply with these new rules. Failure to meet stipulated timelines could result in regulatory sanctions, and banks will be held liable for system failures that allow suspicious inflows to go undetected. Institutions lacking adequate fraud-detection mechanisms face the full brunt of financial losses and potential sanctions.

To prevent such scenarios, the CBN has directed all institutions to enhance their Early Warning Systems, closely monitor red-flag indicators, and maintain dedicated fraud analytics units. Banks are also required to provide 24-hour reporting channels and conduct regular fraud-awareness campaigns to educate customers.

In cases where multiple institutions are involved in a disputed transaction, the originating institution must initiate the investigation promptly and notify the others within 30 minutes. If the institutions fail to resolve the matter within the stipulated period, the case will be escalated to the CBN's Consumer Protection and Financial Inclusion Department for a final decision.

The guidelines, issued by Dr. Rita Sike, Director of the Financial Policy and Regulation Department, invite banks, financial institutions, and the public to provide comments within three weeks. Once finalized, these rules promise to revolutionize the banking sector's accountability standards and consumer protection measures across Nigeria's digital-payment landscape.
